GUARANTEE GENERAL CONDITIONS

 

CONNECTIONS

    1. Buyer means the entity to which the Seller sells Equipment under the Contract;

    2. Contract means an order for Equipment placed by the Buyer, including by electronic means, and accepted (fulfilled) by the Seller, or a contract for the sale of Equipment signed by both parties;

    3. “Equipment” means the equipment, parts, components and other goods sold by the Seller to the Buyer under the Contract;

    4. Seller – UAB “Kasima”, legal entity code 302752257, registered office address Daukanto g. 66, Telšiai;

    5. Warranty Terms – The general terms and conditions of this Warranty, including any Schedules hereto, as amended or supplemented by any changes or additional provisions specifically set out in the Contract or specifically agreed in writing between the Seller and the Buyer;

    6. Operating Instructions – the instructions for use of the Equipment that come with the Equipment.

  1. ACCEPTANCE OF THE TERMS OF THE GUARANTEE

    1. The execution of the Contract between the parties or the purchase of any Equipment shall be deemed to be the Buyer’s acceptance of the terms and conditions of this Warranty.

    2. The terms of this Warranty shall apply to any Equipment acquired from the Seller.

  2. GENERAL CONDITIONS

    1. The Equipment sold by the Seller is not intended to be used for any activity other than those specified in the Instructions and the Buyer warrants that it will not use or permit others to use the Equipment for any other purpose. In the event of a breach of this clause, the Seller shall be relieved of all liability for any damage, injury, expense or contamination. The Buyer shall be personally liable for any damage caused.

    2. Installation, maintenance and servicing of the equipment must be carried out strictly in accordance with the Operating Instructions.

    3. This Warranty applies only to Equipment sold by the Seller. The warranty shall apply exclusively to Purchasers who have purchased the Equipment directly from the Seller.

    4. This guarantee does not apply:

      1. Unique or bespoke Equipment made to the Buyer’s order;

      2. naturally deteriorating parts and components of Equipment;

      3. used equipment for sale.

  3. GUARANTEES

  1. The Seller warrants that the Equipment will be delivered in good quality, free from defects or deficiencies which would limit the use of the Equipment for its intended purpose.

  2. The Equipment shall be warranted for a period of 12 (twelve) months from the date of the VAT invoice issued by the Seller (which corresponds to the date of dispatch of the Goods to the Buyer).

  3. The Seller undertakes to repair the Equipment or replace defective Equipment or parts thereof at its sole discretion.

  4. The Buyer must notify the Seller of any defect in the Equipment within 10 (ten) calendar days of becoming aware of the defect. Warranty repairs carried out by the trader do not extend or renew the warranty period.

  5. In the event of any question as to the quality of the Equipment, the Buyer shall allow the Seller to carry out a diagnostic examination of the Equipment in order to identify any shortcomings and/or defects in the Equipment. The Buyer shall deliver the Equipment to the Seller and shall not prevent the Seller’s authorised persons from carrying out the diagnostics.

  6. The warranty does not apply:

    1. any defects and/or failures of the Equipment caused by the actions of the Buyer or third parties, including, but not limited to, failure to install, store, use, operate and/or maintain the Equipment in accordance with the User Manual;

    2. any defects and/or failures of the Equipment caused by improper maintenance, improper installation, negligence, acts of God, accidents;

    3. any defects and/or malfunctions of the Equipment resulting from the use of the Equipment under improper conditions;

    4. Equipment that is not maintained and/or prevented in accordance with the conditions set out in the Instruction Manual;

    5. any defects and/or malfunctions of the Equipment resulting from a breach of the instructions in the User Manual;

    6. Equipment that has been repaired or modified by the Buyer or a third party;

    7. normal wear, erosion and/or corrosion of the Equipment;

    8. any damage or shortcomings caused by force majeure;

    9. for installations where Equipment is installed (connected).

  7. The warranty does not cover operating or maintenance tools, including parts that may wear out during normal use.

  8. This Warranty is void if the Purchaser does not strictly adhere to the preventive maintenance schedule as specified in the User Guide.

  1. GUARANTEE PROCEDURES

    1. Claims must be submitted to the Seller within four 10 (ten) calendar days of the defect/fault being detected.

    2. The claim must include the following information:

      1. Copy of the PMV invoice;

      2. clear photos and a description of the defect/malfunction.

    3. The Seller shall examine and evaluate each claim within four 10 (ten) calendar days of receipt of the relevant claim.

    4. All warranty work shall be carried out by the Seller or a person authorised by the Seller and shall be carried out using only original spare parts from the Seller.

    5. All spare parts required for warranty work must be purchased only from the Seller.
